The general terms and conditions (hereinafter referred to as “GTC”) apply to all orders placed via the website\/online shop of yopsi solutions Deane (hereinafter referred to as “yopsi.ch”).<\/p>\n
yopsi.ch reserves the right to change the terms and conditions. The version of the General Terms and Conditions valid at the time of the order is decisive and cannot be changed unilaterally for this order.<\/p>\n
If there are differences in the translation, the German version is always legally binding. The translations of these are for information only.<\/p>\n
yopsi.ch offers the printing of documents as a service. Customers can make their document available via the yopsi.ch website, which will then be printed and sent according to the variant(s) selected.<\/p>\n
The prices are in Swiss francs, incl. VAT. The price in the online shop at the time of the order is applicable.<\/p>\n
It is the customer’s responsibility to ensure that the shipping information provided when ordering is correct and complete.<\/p>\n
The order comes about as soon as the customer places their order in the online shop, the print data for creation is complete and legible, and the payment has been made and confirmed. The order confirmation is generated automatically and does not confirm the readability of the data. Since the processing takes place automatically, subsequent changes to the print data are not possible.<\/p>\n
The customer’s delivery address must be in Switzerland or the Principality of Lichtenstein.<\/p>\n
Delivery is by post or other courier services and is included in the purchase price.<\/p>\n
With the order confirmation, the customer will be informed of the provisional delivery date. If yopsi.ch is in default of delivery, the customer has the right to withdraw from the contract from the 20th calendar day. In this case, yopsi.ch refunds the pre-paid price of the product. Claims that go beyond this do not exist against yopsi.ch.<\/p>\n
Tolerances and deviations from the print data that are customary in the industry are reserved. This includes in particular print quality, positioning accuracy, paper quality. We reserve the right to deviations in printing colour, paper or similar within the same or different productions.<\/p>\n
It is up to the customer to check the products for correctness, completeness and damage immediately upon receipt. Any defects or deviations from the order must be notified to yopsi.ch on the day of delivery by email to support@yopsi.ch or by telephone. After that, no defects can be asserted which could have been discovered.<\/p>\n
Either the defective goods will be replaced or the amount paid (in whole or in part) for the defective goods will be credited to the customer by voucher. The decision lies with yopsi.ch. Further customer claims are explicitly excluded. Furthermore, yopsi.ch reserves the right to demand proof of the defect.<\/p>\n
Payments must be made in Swiss Francs CHF.<\/p>\n
Orders are made against prepayment.<\/p>\n
Only credit cards (Visa, Mastercard) and TWINT are accepted as means of payment. Payment is made when the order is placed.<\/p>\n
If the customer is entitled to a credit or refund, these will be credited by voucher.<\/p>\n
Vouchers are valid for 1 year from receipt and can be used for purchases on yopsi.ch.<\/p>\n
By submitting the data (upload), the customer confirms that they have all the necessary reproduction rights, copyrights and distribution rights for the data. Yopsi.ch is not obliged to check the printed matter for third-party rights or violations of the law.<\/p>\n
It is also prohibited to have documents with the following content printed at yopsi.ch:<\/p>\n
1. Content with missing or disputed copyright.<\/p>\n
2. The content violates applicable law (e.g. racism, defamation, etc.)<\/p>\n
3. Pornographic Depictions<\/p>\n
Yopsi.ch reserves the right to refuse orders without giving reasons.<\/p>\n
The customer undertakes to indemnify yopsi.ch against any kind of claims due to infringement of third-party rights, provided these are asserted in connection with the printing of the data. The customer reimburses yopsi.ch for all costs, expenses and claims arising from such a case.<\/p>\n
Swiss law is exclusively applicable to the legal relationship between yopsi.ch and the customer.<\/p>\n
Liability is based on the applicable legal provisions. However, yopsi.ch is not liable for<\/p>\n
1. slight negligence<\/p>\n
2. indirect and direct damage and consequential damage and loss of profit<\/p>\n
3. unrealized savings<\/p>\n
4. Damage resulting from delay in delivery<\/p>\n
5. Copyright Infringement<\/p>\n
In addition, yopsi.ch rejects liability in the following cases:<\/p>\n
1. improper, non-contractual or illegal storage, adjustment or use of the products;<\/p>\n
2. Force majeure, in particular elemental, moisture, fall and impact damage etc. for which yopsi.ch is not responsible<\/p>\n
3. official orders and instructions<\/p>\n
Place of jurisdiction for natural and legal persons is 9400 Rorschach.<\/p>\n
Should a provision of this contract or the content of an annex to this contract integrated into the contract be or become invalid, this shall not affect the validity of the remainder of the contract. The contracting parties will replace the ineffective provision with an effective provision that comes as close as possible to the intended economic purpose of the invalid provision and to the originally agreed contractual balance. The same applies to any gaps in the contract.<\/p>\n
